Terms of Use

NeverDiveAlone · Last updated 2026-09-15

These terms are the agreement between you and David A. Little, Inc. for your use of NeverDiveAlone. By using the app you accept them.

What you may do

Use NeverDiveAlone for your own personal or business purposes. You may not resell it, copy it, take it apart to rebuild it, or use it to break the law or anyone else's rights.

Your account

Keep your sign-in details to yourself. You are responsible for what happens under your account. Tell us if you think someone else has got into it. We can suspend or close an account that is being used to harm other people.

What the app is not

Diving can kill you. NeverDiveAlone does not make it safe.

The app helps you find other divers. It does not verify anyone's certification, experience, health, or competence, and it is not a substitute for your own training, your own checks, or your own judgement. You are responsible for deciding who you dive with and whether a dive is within your limits. Never rely on this app for anything safety-critical.

What you post

You keep ownership of what you post. You give us permission to show it inside the app so the app can work. You must have the right to post it, and it must not break the rules in our EULA.

No warranty, and the limit of what we owe you

NeverDiveAlone is provided "as is". We do not promise it will be accurate, available, or free of faults. To the fullest extent the law allows, David A. Little, Inc. is not liable for lost profits, lost data, or any indirect or consequential loss, and our total liability to you is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five US dollars.

Some places do not allow these limits. Where that is true, they apply to you only as far as the law allows.

Ending this

You can stop using the app and delete it at any time. We can suspend or stop providing the app, in whole or to you, if you break these terms or if we stop running it.

Law

These terms are governed by the laws of the State of Florida, United States, and disputes belong to the courts of the State of Florida.
